Acceptance of These Terms

These Terms of Service (the "Terms") govern your access to and use of Brainrot Shorts, including our website, editor, rendering tools, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you use the Service on behalf of a company, organization, or other entity, you represent that you are authorized to bind that entity to these Terms, and "you" includes that entity.

Eligibility and Account Responsibilities

You must be legally capable of entering into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate information, keep it up to date, and promptly notify us if you believe your account has been accessed without authorization.

  • Do not share your login credentials with unauthorized users.
  • You are responsible for devices, networks, and security settings used to access your account.
  • We may suspend or restrict accounts that appear compromised, abusive, or used in violation of these Terms.

Subscriptions, Billing, and Renewals

Certain features require a paid plan. Paid subscriptions may renew automatically unless canceled before the next billing cycle. Fees, usage limits, and plan features are described at the time of purchase and may be updated from time to time.

Purchasing a paid plan gives you immediate access to digital services and compute resources: your plan's features, included allowances, and any bonus credits become available as soon as your payment is processed.

You authorize us and our payment processors to charge the payment method on file for recurring subscription fees, applicable taxes, and any amounts due for overages or add-on services (if applicable).

  • Fees are generally non-refundable except where required by law or expressly stated by us in writing.
  • You are responsible for all taxes, duties, and similar charges associated with your purchase, except taxes based on our net income.
  • We may change pricing or plan structure with advance notice; changes typically apply to future billing periods unless otherwise stated.

Fair Use of Included and Unlimited Features

Some plans include features described as "unlimited" or as covered by an included generation pool. These descriptions mean you can use the feature freely for normal creative use without drawing on your credit balance; they do not mean infinite computational capacity. Each generation runs on dedicated GPU compute, so unlimited features are subject to fair-use limits and temporary capacity controls designed to keep the Service fast and available for everyone.

Included generation pools refill automatically on a rolling basis. If you exhaust an included pool during a period of unusually heavy use, you can wait for it to refill at no cost, or you may choose to continue generating immediately using credits at the price shown to you before you confirm. We never charge credits for a generation quoted as included without your explicit confirmation.

We may adjust fair-use limits, concurrency limits, and pool sizes over time to reflect capacity and prevent abuse — for example, automation that bypasses rate limits or access controls, shared-account usage, or resale of generations. Using the documented API and MCP integrations within your plan's limits is supported use, not abuse. Abusive usage may also result in suspension under the Acceptable Use section.

Credits, Included Allowances, and Promotional Credits

Credits are a prepaid usage allowance for compute-backed features, not money. Credits have no cash value, are non-transferable, and cannot be redeemed or exchanged for money except where required by law. The credit price of a generation is shown before you confirm it.

Some credits are promotional: for example signup or billing-cycle bonuses, gifted or goodwill credits, and the free credits every new account starts with. Promotional, bonus, free, and trial credits have no cash value, are not refundable, and may carry an expiry date shown in the app. When you generate, credits may be drawn from these allowances before your monthly plan credits.

Using any credit type or included allowance counts as using the Service. A generation that happens to draw on promotional, bonus, free, or trial credits — or on an included generation pool — while you hold a paid subscription is use of your paid subscription, not a substitute for it.

Refund and Cancellation Policy

You may cancel your subscription at any time from the billing portal (open "Manage billing" in the app). Cancellation stops future renewals; it does not refund the current billing period. You keep full access to your plan until the end of the period you have already paid for, unless your account is terminated for a reason described in these Terms. Cancelling mid-period does not create a pro-rata refund of the remaining days.

Purchasing a subscription or credits gives you immediate access to digital services and compute resources. Using the Service means performing any compute-consuming action while you have access: successful AI generations, renders, exports, downloads, media generation, voiceovers, and similar operations all count, regardless of whether the specific operation consumed subscription credits, promotional credits, bonus credits, trial credits, an included generation pool, or another included allowance.

This applies equally before and after cancellation. Because a cancelled subscription stays fully active until the end of the paid period, generations you run after cancelling are use of your paid subscription in exactly the same way as generations run before it. Cancelling shortly after subscribing does not make the billing period "unused" if the Service was used at any point during it.

Once the Service has been used, we cannot refund that use. Generations run on GPU compute, which is incurred and non-recoverable at the moment a generation runs, so used credits, rendered videos, and subscription time already elapsed are not refundable.

AI-generated outputs are probabilistic and vary between runs. A generation that completes successfully is a delivered service even if the result is not what you hoped for: dissatisfaction with the style, quality, usefulness, creativity, similarity, or performance of an output does not mean the Service was not delivered and does not by itself create refund eligibility. Genuine technical failures are different — when a generation fails to complete, the credits it reserved are automatically returned to your balance, and if a technical problem is not resolved that way, contact support and we will make it right.

This does not affect any rights you have under applicable law. Where mandatory consumer protection law grants you a refund or withdrawal right that cannot be excluded, that law prevails.

  • Service not delivered — you paid but never received access: contact support and we will make it right.
  • Duplicate or incorrect charges: contact support with the receipt and we will correct the error.
  • Genuine technical failure: failed generations automatically return their credits; anything beyond that is handled by support.
  • Change of mind, an unused or partially used billing period, or subjective dissatisfaction with AI output: not refundable by itself. Cancel to stop future renewals and keep access until the period ends.
  • Cancelled but still using: usage after cancellation counts exactly like usage before it, so a period in which the Service was used is not an unused period regardless of when the cancellation happened.
  • Promotional, bonus, free, and trial credits: no cash value and never refundable.

Chargebacks and Payment Disputes

If you believe a charge is wrong, please contact us at contact@brainrotshorts.com before opening a dispute with your bank or card issuer when reasonably possible. Most billing problems are fastest to fix directly, and we respond to every billing inquiry. Nothing in these Terms limits any legitimate right you have to dispute a charge.

Initiating fraudulent or bad-faith payment disputes — for example disputing a charge for services you received and used, or repeatedly charging back purchases while continuing to use the Service — violates these Terms. We may suspend or terminate accounts involved in payment fraud, refund abuse, or repeated bad-faith disputes, and we may respond to disputes with records of account activity and delivery.

Acceptable Use and Prohibited Conduct

You may use the Service only for lawful purposes and in compliance with these Terms. You may not use the Service in ways that infringe rights, harm others, or interfere with the operation of the Service.

  • Uploading, generating, or distributing unlawful, defamatory, harassing, hateful, violent, fraudulent, or sexually exploitative content.
  • Infringing intellectual property, privacy, publicity, or other rights of any person or entity.
  • Using the Service to create misleading impersonations, scams, malware, or content intended to cause harm.
  • Attempting to reverse engineer, scrape, probe, or disrupt the Service, including bypassing rate limits, access controls, or security measures.
  • Using automated methods to extract data or outputs at scale except as expressly permitted by us in writing.
  • Abusing refunds, promotions, or free, trial, or promotional credits — for example creating multiple accounts to repeatedly claim free credits or promotions, exploiting a promotion beyond its intended purpose, or circumventing usage limits or plan restrictions.
  • Engaging in payment fraud, or making repeated bad-faith payment disputes for services you received and used.

Your Content and License to Operate the Service

You retain ownership of scripts, uploaded media, and other content you submit to the Service ("User Content"), subject to the rights you grant in these Terms.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, transmit, display, and otherwise use User Content as necessary to provide, maintain, secure, improve, and support the Service, including rendering videos and troubleshooting issues.

You represent and warrant that you have all rights, licenses, and permissions needed for your User Content and your use of the Service.

AI-Generated Output and Compliance Responsibility

The Service may generate audio, video, captions, and other outputs using automated systems and third-party models. Outputs may be inaccurate, incomplete, or unsuitable for your intended use.

You are solely responsible for reviewing and determining whether outputs are lawful, accurate, non-infringing, appropriately disclosed, and fit for publication or commercial use in your jurisdiction and platform.

  • You are responsible for platform-specific compliance (for example, TikTok, YouTube, Instagram, or advertiser rules).
  • You are responsible for any required disclosures (such as sponsored content, AI disclosure labels, or endorsements).
  • We do not guarantee virality, monetization, audience performance, or business results.

Our Intellectual Property

The Service, including software, designs, trademarks, branding, interfaces, and related materials, is owned by Brainrot Shorts or its licensors and is protected by intellectual property laws.

Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you by implication, estoppel, or otherwise.

Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback without restriction or compensation to you.

Third-Party Services and Integrations

The Service may rely on or integrate with third-party providers, including hosting, authentication, payments, analytics, and AI services. We are not responsible for third-party services, their availability, or their independent terms and privacy practices.

Your use of third-party services may be subject to separate agreements between you and those providers.

Service Availability, Suspension, and Changes

We may modify, suspend, or discontinue all or part of the Service at any time, including features, usage limits, pricing, or supported workflows. We may also suspend or terminate access to protect the Service, comply with law, prevent abuse, or address security or operational risks.

We are not liable for any unavailability, interruptions, delays, or loss of data except as required by applicable law.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINROT SHORTS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Indemnification

You agree to defend, indemnify, and hold harmless Brainrot Shorts and its affiliates, officers, directors, employees, contractors, and licensors from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you violated these Terms, created risk for the Service or others, or if required for legal or security reasons.

Sections that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitation of liability, indemnification, dispute terms, and general provisions.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware, except to the extent arbitration is required by a separate written agreement.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date above. Your continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.
